have a sister who has been married for twelve years and has never had a child. She went to a doctor with her husband, and the doctor told them that the problem is with her husband. She is very worried because she wants to have children. What is the Islamic ruling for such a situation? Can she ask her husband for a divorce?
Sheikh Riyâd al-Musaymîrî, professor at al-Imâm University in Riyadh
It is the woman’s right to have children. If she is unable to do so and it is determined that the reason for this is the sterility of the husband, then she has the right to get the marriage annulled. It is equally her right to remain with her husband if that is what she wishes to do.
If the husband in this case refuses to give his wife a divorce, she may appeal to the Islamic court to have the marriage annulled.
